1. About Us

Discount Toy Co is an Australian-owned online toy retailer providing toys, games, puzzles, educational products, collectibles and related products to customers throughout Australia and New Zealand.

Throughout these Terms & Conditions, "we", "our" and "us" refer to Discount Toy Co, and "you" refers to the customer purchasing products from our website.

2. Acceptance of Terms

By accessing, browsing, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

If you do not agree with these Terms & Conditions, please do not use our website.

3. Product Information

We make every effort to ensure product descriptions, images, specifications and pricing are accurate.

However:

  • Product packaging may vary from images shown.

  • Colours may vary depending on your screen settings.

  • Manufacturers may alter product specifications or packaging without notice.

  • Minor variations do not constitute a fault or defect.

If a product contains incorrect information due to an error, we reserve the right to correct the information and notify affected customers.

4. Pricing

All prices displayed on our website are in Australian Dollars (AUD) and include GST where applicable.

We reserve the right to:

  • Change prices at any time without notice.

  • Correct pricing errors.

  • Cancel orders where a genuine pricing error has occurred.

If an order is cancelled due to a pricing error, any payment received will be refunded in full.

5. Orders

All orders are subject to acceptance and availability.

After placing an order, you will receive an order confirmation email. This email confirms receipt of your order but does not constitute acceptance of the order.

We reserve the right to:

  • Refuse or cancel any order.

  • Limit quantities purchased.

  • Cancel orders suspected of fraudulent activity.

  • Cancel orders where products become unavailable.

If an order is cancelled after payment has been made, a full refund will be issued.

6. Product Availability

While we endeavour to maintain accurate stock levels, stock discrepancies may occasionally occur.

If an item becomes unavailable after purchase, we may:

  • Offer a substitute product;

  • Offer a backorder where available; or

  • Provide a refund for the unavailable item.

7. Promotional Offers & Discounts

From time to time, Discount Toy Co may offer promotions, discounts, coupon codes or sales.

Unless otherwise stated:

  • Promotions cannot be used in conjunction with other offers.

  • Promotions apply only during the advertised period.

  • Discounts cannot be applied retrospectively.

  • Promotions may be modified or withdrawn at any time.

8. Shipping & Delivery

Delivery timeframes provided are estimates only.

We use a range of carriers including Australia Post, Aramex, Couriers Please and other courier partners.

While we make every effort to dispatch orders promptly, we are not liable for delays caused by:

  • Postal or courier delays;

  • Weather events;

  • Industrial action;

  • Public holidays;

  • Customs processing;

  • Circumstances beyond our control.

Risk in goods passes to the customer upon delivery.

9. Parcel Insurance

Customers may be offered the option to purchase parcel protection or shipping insurance at checkout.

Where parcel protection is declined:

  • Discount Toy Co is not responsible for loss, theft or damage occurring after the parcel has been handed to the carrier, except where required by Australian Consumer Law.

  • Customers are encouraged to purchase parcel protection for added peace of mind.

Nothing in this clause excludes any rights available under Australian Consumer Law.

10. Incorrect Addresses & Uncollected Parcels

Customers are responsible for ensuring delivery details are correct at the time of ordering.

Where a parcel is:

  • Returned due to an incorrect or incomplete address; or

  • Returned because it was not collected from the courier's nominated collection point within the required timeframe;

the customer will be responsible for any return-to-sender fees, redirection charges, and any additional postage costs required for re-delivery.

11. Click & Collect

Where Click & Collect is offered:

  • Customers will receive notification when their order is ready for collection.

  • Orders must not be collected until this notification has been received.

  • Photo identification may be required upon collection.

  • Orders not collected within a reasonable period may be cancelled and refunded at our discretion.

12. Change of Mind Returns

We offer a generous Change of Mind Returns Policy.

To qualify:

  • Return requests must be made within 30 days of receiving your order.

  • Products must be unused, unopened, and in original saleable condition.

  • Original packaging must be intact.

Shipping costs are non-refundable.

13. Faulty, Damaged or Incorrect Products

If a product arrives damaged, faulty, or differs substantially from its description, please contact us as soon as possible.

To assist us in assessing your claim and determining the appropriate remedy, customers must provide reasonable evidence of the reported issue. This will generally include clear photographs and/or videos showing the fault, damage, incorrect item received, packaging, and any relevant product labels or barcodes.

Discount Toy Co is unable to assess, approve, replace, refund or otherwise remedy a claim until sufficient evidence has been provided to verify the issue. Where requested evidence is not supplied, we may be unable to process the claim.

Once the issue has been verified, we will provide an appropriate remedy in accordance with Australian Consumer Law, which may include a repair, replacement, refund or other remedy as required.

Depending on the nature of the claim, we may also request that the item be returned to us or to the manufacturer for inspection before a remedy is provided.

14. Product Recalls & Safety Notices

The safety of our customers is important to us.

From time to time, manufacturers, suppliers, regulators or government authorities may issue safety recalls, product withdrawals, hazard alerts or other safety notices relating to products sold by Discount Toy Co.

Where we become aware of a product recall or safety issue affecting a product purchased from us, we may attempt to contact affected customers using the contact details provided at the time of purchase. It is the customer's responsibility to ensure their contact information is accurate and kept up to date.

Customers are encouraged to immediately stop using any product subject to a recall or safety notice and to follow the instructions provided by the manufacturer, supplier, regulator or Discount Toy Co.

Where applicable, remedies relating to recalled products may include repair, replacement, refund, product modification or other remedies as determined by the manufacturer, supplier or applicable regulatory authority.

Discount Toy Co is not responsible for recalls, safety notices or product defects originating from manufacturers or suppliers. However, we will make reasonable efforts to assist customers in obtaining any remedies available in relation to affected products.

15. Age Recommendations & Adult Supervision

Age recommendations displayed on product packaging, product descriptions and our website are provided by manufacturers and are intended as general guidance only.

Parents and guardians are responsible for determining whether a product is suitable for a particular child, taking into account the child's age, abilities, maturity and level of supervision.

Many toys contain small parts and may present a choking hazard for young children. Products should always be used in accordance with the manufacturer's instructions, warnings and safety guidelines.

Discount Toy Co accepts no responsibility for injury, loss or damage arising from the misuse of products, failure to follow manufacturer instructions, or inadequate adult supervision.

16. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

Where goods are supplied to consumers, they come with guarantees that cannot be excluded under Australian Consumer Law.

17. Pre-Orders

From time to time, Discount Toy Co may offer products for purchase on a pre-order basis.

By placing a pre-order, you acknowledge and agree that:

  • Pre-order products are not currently in stock and are expected to arrive at a future date.

  • Any estimated arrival or dispatch dates provided are estimates only and may change due to factors outside our control, including supplier delays, manufacturing delays, shipping disruptions, customs clearance, or other unforeseen circumstances.

  • We do not guarantee any specific dispatch or delivery date for pre-order items.

  • If your order contains both in-stock and pre-order products, your order may be held and shipped once all items are available unless otherwise stated.

  • Payment for pre-order items is generally processed at the time the order is placed.

  • If a supplier cancels, discontinues, or is unable to fulfil a pre-order item, we will notify you and provide a refund for the affected item.

  • Customers may request cancellation of a pre-order prior to dispatch. Once a pre-order item has been dispatched, our standard Returns & Refunds Policy will apply.

Discount Toy Co is not liable for delays caused by suppliers, manufacturers, freight carriers, customs processing, or other circumstances beyond our reasonable control.

18. Buy Now Pay Later Services

Discount Toy Co may offer payment options through third-party Buy Now Pay Later providers, including PayPal Pay in 4.

By selecting a Buy Now Pay Later payment method, you enter into a separate agreement with the relevant provider and agree to be bound by their terms, conditions, lending criteria, privacy policies, and payment schedules.

Discount Toy Co:

  • Does not control the approval process for Buy Now Pay Later applications.

  • Is not responsible for decisions made by the provider regarding eligibility or approval.

  • Is not responsible for any fees, charges, interest, penalties, or account management matters imposed by the provider.

  • Cannot alter, pause, amend, or cancel payment arrangements entered into between you and the provider.

Refunds for purchases made using a Buy Now Pay Later service will be processed in accordance with our Returns & Refunds Policy. Any adjustments to repayment schedules, instalments, or account balances will be managed by the Buy Now Pay Later provider in accordance with their terms and conditions.

Customers should ensure they understand the terms and obligations associated with any Buy Now Pay Later service before selecting it as a payment method.

19. Gift Cards

If gift cards are offered:

  • Gift cards are not redeemable for cash.
  • Lost or stolen gift cards may not be replaced.
  • Gift cards must be used before their expiry date where applicable.
  • Any unused balance remains available until expiry.

20. Intellectual Property

All content on this website, including:

  • Logos;
  • Images;
  • Graphics;
  • Product descriptions;
  • Website design;
  • Text and content;

remains the property of Discount Toy Co or its licensors and may not be copied, reproduced or distributed without written permission.

21. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental or consequential loss arising from the use of our website or products.
  • Our liability for any claim relating to products purchased from us is limited to the amount paid for those products.

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.

We do not guarantee that our website will operate continuously or without interruption.

We reserve the right to:

  • Suspend access;
  • Modify content;
  • Update functionality; or
  • Remove products and services

without notice.

24. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.
